This Privacy Policy applies to personal information SocialPour processes in connection with the Services.

It does not apply to independent third-party websites, social networks, payment providers, or other services that maintain their own privacy policies.

It also distinguishes between information SocialPour collects for its own business purposes and information SocialPour processes on behalf of its business customers.

2. Our Role When Processing Information

SocialPour may act in different privacy roles depending on the circumstances.

When we collect information about account holders, website visitors, prospective customers, or individuals who communicate directly with SocialPour, SocialPour generally determines the purposes for which that information is processed.

When a business customer uploads, connects, or processes information about its own customers, subscribers, guests, or marketing contacts through SocialPour, the business customer generally determines the purpose of that processing and SocialPour processes the information to provide the requested Services.

If you received a marketing message from a restaurant, bar, lounge, café, or other SocialPour customer, requests concerning that business’s marketing list should ordinarily be directed to the business that sent the communication. SocialPour will assist customers with privacy obligations where required.

3. Personal Information We May Collect

The information we collect depends on how you interact with SocialPour.

Account and Identity Information

We may collect your name, business name, job title, username, email address, telephone number, account identifiers, login information, and other profile information.

Business Information

We may collect information about your restaurant, bar, lounge, café, hospitality business, agency, or other organization, including business contact information, locations, branding, website information, marketing preferences, and social-media accounts.

Subscription and Transaction Information

When you purchase a subscription or paid service, we may collect information relating to your plan, transaction, billing status, payment history, billing contact, and related records.

Payment-card information may be collected and processed directly by a third-party payment processor. SocialPour may receive transaction confirmations, card type, expiration information, or other limited billing details rather than the complete payment-card number.

Customer Content

We may process content you create, upload, or provide through SocialPour, including text, prompts, images, videos, logos, menus, promotions, events, offers, flyers, campaign information, and other marketing materials.

Customer Audience Data

If you use SocialPour for email, SMS, customer engagement, or audience-management functions, we may process information you provide concerning your customers or contacts.

This may include names, email addresses, telephone numbers, subscription or consent status, customer segments, campaign engagement information, suppression records, and related marketing data.

Social Media and Integration Data

When you connect a third-party platform, SocialPour may receive information made available through that platform’s authorization process.

Depending on the integration and permissions you approve, this may include account identifiers, page or profile information, authentication tokens, connected business accounts, published content, engagement information, campaign information, and analytics.

AI Feature Information

When you use artificial-intelligence features, we may process prompts, instructions, uploaded content, business information, generated responses, editing selections, feedback, and related information needed to provide the requested AI functionality.

If you contact us, request support, complete a form, schedule a demonstration, or otherwise communicate with SocialPour, we may collect your contact information and the contents of your communication.

6. Artificial Intelligence and Automated Processing

SocialPour may use third-party artificial-intelligence infrastructure, machine-learning providers, or related technology to deliver AI-assisted features.

Information submitted to an AI feature may be transmitted to service providers acting on our behalf to generate the requested output or provide related functionality.

We may process prompts, outputs, feedback, and interaction information to operate, secure, evaluate, troubleshoot, and improve SocialPour’s AI features.

Users should avoid entering highly sensitive personal information into AI prompts unless it is necessary for the intended business purpose and they have the legal authority to do so.

AI-generated content should be reviewed before it is published or relied upon.

7. How We Disclose Personal Information

We may disclose personal information to service providers and contractors that help us operate SocialPour, including cloud-hosting providers, infrastructure providers, cybersecurity providers, customer-support providers, payment processors, email-delivery providers, SMS and messaging providers, analytics providers, artificial-intelligence technology providers, database providers, and other vendors that support our operations.

We may disclose information to third-party platforms when you request an integration or instruct SocialPour to publish, transfer, synchronize, or retrieve information through that platform.

We may disclose information if we reasonably believe disclosure is required by law, legal process, court order, governmental request, regulatory obligation, or to protect the rights, safety, property, and security of SocialPour, our users, or others.

We may disclose information at your direction or with your consent.

8. Sale, Sharing, and Targeted Advertising

SocialPour does not sell personal information for money.

Depending on the technologies used on our website or Services, certain disclosures of identifiers or internet activity to advertising, analytics, or marketing partners could be considered “sharing,” “targeted advertising,” or a “sale” under certain state privacy laws even where no money changes hands.

Where applicable law grants a right to opt out of such processing, SocialPour will provide an appropriate method for exercising that choice.

Even if you opt out of marketing communications, we may continue sending transactional, security, account, billing, legal, or service-related communications where appropriate.

If SocialPour sends marketing text messages directly to you, you may withdraw consent using the opt-out instructions included in those messages.

For promotional messages sent by a SocialPour business customer, follow the opt-out instructions contained in that customer’s message or contact the sending business.

11. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to maintain an account, provide Services, satisfy contractual obligations, maintain transaction and business records, resolve disputes, enforce agreements, protect against fraud and abuse, and satisfy legal, tax, accounting, regulatory, or security requirements.

The retention period for particular information depends on the nature and sensitivity of the information, why it was collected, the length of the customer relationship, applicable contractual requirements, and applicable law.

When information is no longer required, we may delete, anonymize, aggregate, or otherwise securely dispose of it.

SocialPour does not sell personal information for money.

SocialPour may assist its customers with such requests as required by applicable law or contractual commitments.

18. Third-Party Platforms and Links

SocialPour may contain links to or integrations with third-party services including social networks, websites, payment services, and other technology providers.

When you interact directly with a third party, its privacy practices govern the information it independently collects and processes.

SocialPour is not responsible for the privacy or security practices of independent third-party services.

We encourage users to review the privacy policies and permissions of connected platforms.

SocialPour is a business-oriented service and is not directed to children under 13.

We do not knowingly collect personal information directly from children under 13 through the Services.
